Driscoll announced today that his firm is representing 38 plaintiffs who have filed a lawsuit in St. Clair County Circuit Court in Illinois against Takeda Pharmaceuticals U.S.A, Inc., the manufacturer of the Actos diabetes drug.
According to the lawsuit, the plaintiffs claim they were diagnosed with bladder cancer after consuming Actos, or pioglitazone, which the U.S. Food and Drug Administration (FDA) has approved for use in improving control of blood sugar in adults with type 2 diabetes mellitus.
Their illness has forced them to pay undue medical costs as well as to experience physical pain, mental anguish and a loss of enjoyment of life, the plaintiffs allege in the complaint.
In June 2011, the FDA issued a safety communication, informing the public that the use of Actos for more than one year “may be associated with an increased risk of bladder cancer.” The FDA also mandated a labeling change to include information about this risk.
In the complaint (Case No. 13-L-16), which was filed on January 9, 2013, the plaintiffs allege that they were unaware of that risk at the time they used the medication.
The lawsuit asserts claims for failure to provide a proper warning as well as strict liability, negligence, defective design, breach of express warranty and breach of implied warranty.
