Attorney Driscoll Charges Maker of Actos with Causing Bladder Cancer

The Driscoll Firm, LLC, is representing 38 plaintiffs named in the lawsuit filed in St. Clair County Circuit Court in Illinois, alleging that the manufacturer of Actos failed to warn of an increased risk of bladder cancer associated with the diabetes medication.

St. Louis, MO (Vocus/PRWEB) February 23, 2013 – Nationally recognized drug injury lawyer John J. Driscoll announced today that his firm is representing 38 plaintiffs who have filed a lawsuit in St. Clair County Circuit Court in Illinois against Takeda Pharmaceuticals U.S.A, Inc., the manufacturer of the Actos diabetes drug.

According to the lawsuit, the plaintiffs claim they were diagnosed with bladder cancer after consuming Actos, or pioglitazone, which the U.S. Food and Drug Administration (FDA) has approved for use in improving control of blood sugar in adults with type 2 diabetes mellitus.

Their illness has forced them to pay undue medical costs as well as to experience physical pain, mental anguish and a loss of enjoyment of life, the plaintiffs allege in the complaint.

In June 2011, the FDA issued a safety communication, informing the public that the use of Actos for more than one year “may be associated with an increased risk of bladder cancer.” The FDA also mandated a labeling change to include information about this risk.

In the complaint (Case No. 13-L-16), which was filed on January 9, 2013, the plaintiffs allege that they were unaware of that risk at the time they used the medication.

The lawsuit asserts claims for failure to provide a proper warning as well as strict liability, negligence, defective design, breach of express warranty and breach of implied warranty.

The lawsuit has been reported on by The Madison-St. Clair Record legal journal.

Driscoll, the founder of The Driscoll Firm, LLC, represents plaintiffs across the United States in product liability and personal injury litigation, including cases involving dangerous pharmaceuticals and defective medical devices.

The attorney urged Actos users to be on alert for symptoms of bladder cancer, which the FDA identifies as blood or red color in urine, the urgent need to urinate, pain while urinating and pain in the back or lower abdomen. He also noted that the FDA has recommended that doctors not prescribe Actos to those with active bladder cancer or a prior history of the disease.
