More and more product liability lawsuits are being filed against GranuFlo and NaturaLyte manufacturer, Fresenius, as patients subjected to these dangerous dialysate solutions used in kidney dialysis machines are being injured – or dying. A South Carolina son whose father died during a routine kidney dialysis session in which GranuFlo was used has filed the latest GranuFlo lawsuit.
Latest GranuFlo Lawsuit
The GranuFlo drug injury lawsuit was filed by Clarence Lee Dubose, Jr., of South Carolina against Fresenius Medical Care after his father died of a heart attack during a routine dialysis procedure that involved GranuFlo. The lawsuit, filed in U.S. District Court of Massachusetts in December 2012, alleges breach of warranty, strict liability and negligence. Specifically, it alleges that the company:
- Knew that GranuFlo and NaturaLyte caused dangerously high levels of bicarbonate which could result in serious side effects or death
- Failed to warn patients and doctors about those risks
At the crux of this lawsuit, and others like it, is an internal Fresenius memo that revealed that these products were resulting in heart attacks. The company used that information to warn its own medical centers, but failed to warn the hundreds of other medical centers around the nation that purchase GranuFlo and NaturaLyte from them – leaving thousand of patients at risk. Those actions (or inactions) have resulted in nearly 1,000 heart attacks that could have been avoided.
